Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website and services provided by Workify360 ("we", "our", or "us"), including the Focus desktop client, the web dashboard and related services (together, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf. If you do not agree, please do not use the Services.

2. Description of the Services

Focus helps organizations understand how work time is spent. Depending on your plan and configuration, the Services may include:

• Automatic tracking of application and website usage, active time and idle time
• Productivity calculation based on configurable categories
• Project time tracking, timesheets and reports
• Optional features such as screenshots, where enabled by the customer
• Privacy features such as private time and role-based access

3. Accounts

• You must provide accurate and complete information when creating an account and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must notify us promptly of any unauthorized use of your account or any security incident.
• Account administrators are responsible for managing the users, roles and settings within their organization.

4. Customer Responsibilities for Monitoring

When an organization uses Focus to track the activity of its employees or contractors, that organization decides how the Services are configured and used. The customer is responsible for:

• Ensuring that its use of the Services complies with applicable laws, including employment, privacy and data protection laws
• Having an appropriate legal basis for processing personal data of the people being tracked
• Informing the people being tracked about what data is collected, why, and who can access it
• Configuring optional features, such as screenshots, only where their use is justified and lawful

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or to monitor individuals without the notice or legal basis required by law
• Attempt to gain unauthorized access to the Services, other accounts or related systems
• Interfere with or disrupt the integrity or performance of the Services
• Reverse engineer, resell or sublicense the Services, except as permitted by law or by us in writing
• Upload or transmit malicious code or content that infringes the rights of others

6. Plans, Trials and Payment

Paid plans and their features are described on our pricing page. Where a free trial is offered, its duration and conditions are shown at sign-up.

• Fees are billed in advance for the selected billing period unless stated otherwise.
• You are responsible for any taxes applicable to your purchase.
• We may change our prices with reasonable prior notice; changes apply from the next billing period.

7. Customer Data and Privacy

You retain ownership of the data you and your users submit to or generate through the Services ("Customer Data"). You grant us the rights necessary to host, process and display Customer Data solely to provide and improve the Services.

How we handle personal data is described in our Privacy Policy. Where required, the processing of personal data on behalf of a customer is governed by a separate data processing agreement.

8. Intellectual Property

The Services, including software, design, text and trademarks, are owned by Workify360 or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription.

The Focus desktop client includes open-source components that are licensed under their own terms. Nothing in these Terms limits your rights under those licenses.

9. Availability and Changes

We aim to keep the Services available and reliable, but we do not guarantee that they will be uninterrupted or error-free. We may modify, add or remove features over time. Where a change materially reduces the functionality of a paid plan, we will inform you in advance.

10. Term and Termination

• You may stop using the Services and cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• We may suspend or terminate access if you materially breach these Terms or if required by law.
• After termination, you may request an export of your Customer Data within a reasonable period, after which it may be deleted in accordance with our Privacy Policy.

11. Disclaimers

The Services are provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Productivity metrics and reports are intended to support, not replace, human judgment.

12. Limitation of Liability

To the extent permitted by law, Workify360 will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data, arising from your use of the Services. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. The Istanbul Anatolian Courts and Enforcement Offices have jurisdiction over disputes arising from these Terms. Where you are a consumer, your right to apply to the Consumer Arbitration Committees and Consumer Courts under Law No. 6502 is not affected.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Where changes are material, we will provide reasonable notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
